The ACLU claim was that there were 1 million people on the _no fly
list_.
That's false. They said:
"More that 900,000 people are currently listed as suspected
terrorists
on the US government's "do not fly" list,"
There aren't a million people on the no-fly list. It's about an order
of magnitude smaller. They conflated the terrorist watch list with the
no-fly list.
Furthermore, the terrorist watch list is not limited to US residents,
and may include the same person under multiple names. Osama bin Laden
is presumably not in the US. He's also on the terrorist watch list,
and he's on it under "Usama", "Osama", and several other
transliterations from Arabic to English. Ditto for the people on it
under "Mohammed", "Muhammed", etc.
